1. Scope and relationship to other policies

This Image Upload Policy applies whenever a user uploads or supplies an image, artwork, prompt, reference, or related instruction to create a preview, digital model, physical figurine, gallery item, or business project. It is incorporated into the Terms. The Privacy Policy governs personal-data processing; these more specific upload rules control the content, authority, consent, AI/3D workflow, and deletion of Uploaded Content and Creation Data.

2. Required upload confirmations

Before InkMee processes an identifiable person’s image, the uploader must actively confirm:

  1. Adult and authority: “I am 18 or older and have the right and permission to upload this content and request this creation.”
  2. Depicted persons: “Each identifiable person has consented where required, or I otherwise have lawful authority to act for them.”

3. Child image: if a child is depicted, “I am the parent/legal guardian, or I have documented

permission from the parent/legal guardian and any other authority required by law.”

4. Facial/body creation processing: “I understand InkMee and contracted providers may analyze

visible face, body, pose, hair, clothing, and related geometry solely to create, refine, print, support, and secure this private project, as described in the Privacy Policy.”

5. Policies: “I have read and agree to the Terms, Privacy Policy, and Image Upload Policy.”

Where written or express biometric/sensitive-data consent is required, InkMee presents the facial/body confirmation as a separate, unticked checkbox and records the notice version, date/time, account/order, region, and choice. An uploader who cannot provide a valid confirmation may not upload the image.

  1. Content you may upload
  • Your own photo or artwork; a family, couple, friend, wedding, memorial, or pet image you are authorized to use; and clothing, object, pose, or setting references that do not violate rights or law.
  • A child’s image only through an authorized adult under Section 2 and subject to the Children and Family Uploads rules below.
  • A commissioned or licensed photograph only if the license permits the intended reproduction, adaptation, 3D creation, private display, gifting, and any requested commercial/public use.
  • Third-party characters, logos, uniforms, products, artworks, or brands only where you have a license or the requested use is otherwise lawful. InkMee may require proof or refuse uncertain content.
  1. Content you must not upload or request
  • Child sexual abuse material; sexualized, exploitative, abusive, or humiliating content involving a minor; grooming or content that endangers a child.
  • Non-consensual intimate imagery, sexual deepfakes, voyeuristic content, or intimate content of a person who did not validly consent.
  • Content used to threaten, stalk, harass, defame, impersonate, discriminate, incite violence, facilitate trafficking or abuse, or commit fraud or another crime.
  • A person’s image obtained through unlawful surveillance, hacking, coercion, breach of confidence, or violation of a court/protection order.
  • Content that infringes copyright, trademark, publicity, privacy, design, contractual, or other rights;

counterfeit merchandise; or unauthorized commercial endorsement.

  • Malware, hidden code, files intended to disrupt the service, or content that exposes passwords, financial credentials, government identifiers, medical records, or other unnecessary sensitive information.
  • Deceptive political, evidentiary, identity, credential, or news uses that falsely represent the output as authentic conduct, speech, approval, or documentation of a real person.
  • Anything illegal in the uploader’s, depicted person’s, production, shipment, or destination jurisdiction, or prohibited by sanctions/export rules.
  1. Third parties, couples, families, and groups A person can have privacy and publicity rights even when the uploader owns the photo. For couples, families, weddings, teams, or groups, obtain consent from each identifiable adult when required. Do not use InkMee to create a secret, humiliating, sexual, defamatory, commercial, or deceptive representation of another person. If a person withdraws permission before production and their rights require cessation, InkMee may pause or cancel the affected project.

6. Children and family uploads

Children cannot be InkMee users or contracting customers. A child may appear in a private family creation only through a responsible adult with lawful authority.

  • Use only images appropriate for a family collectible. Never upload nude, sexualized, exploitative, medical, disciplinary, humiliating, or otherwise high-risk images of a child.
  • Do not include a child’s full name, school, address, exact location, government identifier, medical information, or other unnecessary sensitive details in a file name, prompt, message, or public caption.
  • Child images remain private and are not used for targeted advertising, generalized AI training, or a public gallery without a separate, legally valid parent/guardian release and any consent required from the child based on age and local law.
  • InkMee may request guardian verification proportionate to risk, pause the project, or delete content if authority is doubtful. InkMee minimizes verification documents and deletes them when no longer needed.

7. Deceased persons, memorial projects, and pets

  • For a deceased person, ensure the creation is respectful and lawful and that you have any permission required from the estate, next of kin, photographer, or rights holder. Public or commercial use may require stronger authority than a private memorial gift.
  • For a pet, confirm you own the image or have the photographer/owner’s permission. Do not request content depicting animal cruelty or facilitating abuse.
  • InkMee may refuse memorial or pet projects that create a substantial privacy, dignity, rights, safety, or fraud concern.

8. Public figures, brands, and fictional characters

A public image being available online does not mean it is free to copy into merchandise. Uploading celebrities, athletes, influencers, politicians, fictional characters, logos, jerseys, branded designs, game assets, or other protected material may require copyright, trademark, publicity, merchandising, or endorsement rights. InkMee may refuse the project, limit it to a lawful private use, require proof of license, remove brand elements, or offer an original alternative. InkMee does not guarantee that a requested use is fair use, parody, or otherwise lawful.

9. The permitted creation workflow

  1. Secure intake: receive the image and project instructions; remove unnecessary metadata where configured; perform malware and policy checks.
  2. AI-assisted interpretation: analyze visible subject, pose, hair, clothing, objects, color, depth, and style to create an initial artistic direction.
  3. 3D reconstruction: generate or construct geometry, infer unseen sides, form a mesh, create textures, and prepare a draft model.
  4. Human refinement: adjust likeness cues, topology, thickness, connections, balance, supports, color, base, and manufacturing feasibility.
  5. Production review: check the refined design for production readiness and record the review outcome with the order.
  6. Production and quality control: print, cure/finish, inspect, package, and ship the personalized product.
  7. Support and deletion: retain project files for the disclosed short support period, resolve issues, then delete or archive only with a separate customer choice.

10. Facial/body geometry and biometric safeguards

  • InkMee may derive temporary measurements, landmarks, depth maps, or geometry from an image to create the figurine. Depending on law, some of this data may be treated as biometric or sensitive even though InkMee does not use it to recognize identity.
  • The purpose and retention period are disclosed before capture. Required written/express consent is obtained from the depicted person or legally authorized representative.
  • InkMee does not identify, authenticate, surveil, track, compare against a database, score, or make consequential decisions about a person using this data.
  • InkMee does not sell, lease, trade, profit from, or use facial/body geometry for advertising or generalized AI training.
  • Contracted processors receive only the data needed for creation and are bound by confidentiality, security, no-training, no-independent-use, return/deletion, incident, and audit terms.
  • The data is deleted when the creation purpose and support window end, normally within 90 days after delivery/cancellation, subject to a valid earlier request and narrow legal holds.

11. AI limitations and responsible output

AI may invent unseen details, simplify or exaggerate features, reproduce bias, omit accessories, misread age/pose/clothing, or produce an image that is not sufficiently similar. A preview is not a verified identity representation. Human review improves printability and quality but cannot guarantee exact likeness or eliminate all error. Users must not present an output as an authentic photograph, identity document, evidence, official statement, or endorsement of the depicted person.

12. Model training and service improvement

Default rule: InkMee does not use private Uploaded Content, facial/body geometry, private prompts, or personalized 3D models to train generalized, foundation, public, or third-party AI models. InkMee contractually and technically disables training for operational vendors.

InkMee may improve the Services using aggregated performance metrics, error statistics, production measurements, synthetic content, licensed datasets, public-domain material, employee/contractor test data, or other data that does not include private customer projects. If InkMee later proposes using customer projects for training or research, InkMee will introduce a separate, optional, specific opt-in that is not required to purchase, explain whether withdrawal can affect completed model training, update the Privacy Policy, and complete any necessary impact assessment.

13. Human access and confidentiality

Authorized staff and contractors may view a private project only when needed for refinement, production, quality, support, safety, fraud, rights complaints, or legal compliance. Access is role-based, logged where appropriate, and subject to confidentiality. InkMee prohibits downloading private uploads to personal devices, copying them into portfolios, discussing them publicly, or moving them into public, gallery, or training folders.

14. Public gallery, social media, testimonials, and advertising

A private upload and purchase do not permit public use. InkMee obtains a separate release that states the exact assets, channels, territory, duration, attribution, editing, paid-ad use, and withdrawal process.

InkMee presents the public-use checkbox as optional, unticked, and separate from the required service terms. Refusal does not affect price or service unless a genuine, separately explained promotion lawfully depends on the license.

On valid withdrawal, InkMee will stop new use and remove content from channels it controls within a reasonable period stated in the release, normally 30 days. Withdrawal does not necessarily require recall of printed materials already distributed or remove copies independently shared by others, but InkMee will not create new uses after the effective withdrawal where consent is the basis.

15. Image quality and production suitability

  • Use a clear, well-lit, high-resolution image with the face, hair, clothing, body pose, and important accessories visible. Additional angles may improve accuracy.
  • Avoid heavy filters, motion blur, extreme shadows, large obstructions, tiny faces, screenshots with interface elements, compressed messaging-app copies, and cropped hands/feet when those details matter.
  • Do not upload unnecessary background people or private documents. Crop or blur unrelated individuals where possible before uploading.
  • InkMee may request another photo or may infer hidden details. A low-quality or single-view reference increases artistic variation and is not a basis for claiming exact unshown details were promised.

16. Review, rejection, and reporting

InkMee may automatically screen and human-review content for malware, technical suitability, illegality, child safety, non-consensual intimate imagery, threats, impersonation, fraud, rights infringement, sanctions, and other policy risks. InkMee may reject, restrict, delete, preserve, or report content where reasonably necessary or legally required. To report an upload or output involving you, a child, unlawful intimacy, impersonation, or rights infringement, contact safety@inkmee.studio and provide enough information to locate the project without sending unnecessary sensitive material.

17. Copyright notice and counter-notice

Send copyright complaints to legal@inkmee.studio and the designated agent listed in the Terms. A valid notice should identify the protected work, challenged material, contact information, good-faith belief, accuracy/authority statement, and signature. Where the US DMCA applies, a counternotice must identify the removed material and prior location, contain the required good-faith statement and consent to jurisdiction, and be signed. False notices can create liability. InkMee may remove public content and terminate repeat infringers where appropriate.

18. Retention, deletion, and cancellation effects

Stop new use and remove from controlled channels within the stated period, normally 30 days, subject to completed print uses and lawful records.

19. Responsibility and remedies

You are responsible for having the rights and authority you confirm. InkMee is responsible for following its disclosed processing limits, protecting data, enforcing vendor terms, responding to valid complaints, and providing mandatory remedies. If a project is rejected for policy reasons, InkMee will explain at a useful level where safe and lawful and will refund the unperformed portion unless the user’s breach, fraud, chargeback, or law permits a different outcome.

20. Changes and contact
